In Virginia, What is the difference between drunk driving and driving on prescription medications?

My friend wants me to get him some information on this before he gets an attorney. He got pulled over and taken to jail for driving while on 2 pills of Xanex. Yes, he was swirving and it was not safe, but is there a legal difference between that and driving while intoxicated or on illegal drugs?

I’d hope the only difference is that he doesn’t get in trouble for the REASON he is under the influence. He was still DUI, and reckless driving. I don’t care if it was prescription medication. Most people who go on medication understand that you give it a little time to see how it effects you.
Unfortunately for your friend, the law in most states is “under the influence” not “drunk driving” so the same laws apply. I strongly suggest he get a lawyer and do what he can to plea it down. If they have tape of him swerving and/or blood work/confession it is a done deal that he will be convicted without representation.
most medications say do not drive or operate heavy machinery while taking them.. the law usually has its bases covered so no i don’t think there is gonna be a difference and your friends in trouble.. like they tell you in drivers ed if you tired pull over and sleep i think the same applies here.have some common courtesy for the safety of yourself and others and PULL OVER!. life is beautiful!
